1. Who We Are

Red Pine Creative Marketing LLC (“Red Pine,” “we,” “our,” or “us”) provides (a) done-for-you website design, (b) a software-as-a-service marketing platform, and (c) related digital-marketing and consulting services (collectively, the “Services”). By accessing our website https://redpinemarketing.com (“Site”) or using any Service, you agree to these Terms & Conditions (“Terms”).

2. Eligibility

You must be at least 18 years old and able to enter a legally binding contract.

3. Scope of Services

Website design packages (Side Hustle, Small Business, Growing Business, Established Business)

Red Pine CRM platform (sales pipeline, calendar, payments, automations, SMS & email tools)

Optional add-ons (SEO, print, media) sold under separate work orders

4. Proposals, Payments & Refunds

4.1 Proposals remain valid for 14 days. A project begins when setup payment is received.
4.2 Payments are processed via Stripe; recurring SaaS fees bill monthly to your card on file.
4.3 Refunds — Setup fees are refundable within 7 days only if design work has not started. SaaS fees are non-refundable once the billing cycle begins.
4.4 Late Payments — Accounts 7+ days past due may suspend hosting, automations, and platform access.

5. Your Responsibilities

You agree to provide timely content and approvals, keep login credentials secure, and use the platform in compliance with all applicable SMS/email marketing laws (including TCPA, CAN-SPAM, and CASL).

6. Intellectual Property

Final design and copy are yours upon full payment. Red Pine retains all rights to its proprietary code, templates, and automations, licensed to you for use inside the Red Pine platform.

7. Limitation of Liability

Red Pine’s total liability will not exceed the fees you paid to Red Pine in the 3 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.

8. Disclaimer

Results such as rankings, leads, or revenue depend on many external factors. Red Pine makes no guarantees or warranties regarding performance or outcomes.

9. Termination

Either party may terminate this agreement with 30 days’ written notice. Any outstanding fees become due immediately. You may request a data export before termination takes effect.

10. Governing Law

These Terms are governed by the laws of the State of Utah. Any dispute will be resolved in the state or federal courts located in Salt Lake County, Utah.

11. Changes

We may update these Terms at any time by posting a revised version on our website. Continued use of our Services constitutes acceptance of any changes.
